What is the National Biodiversity Authority (NBA)?

The Central Government launched the National Biodiversity Authority (NBA) in 2003 to carry out India's Biological Diversity Act (2002), which requires the decentralized performance of the Act's requirements. The National Biodiversity Authority is a Statutory, Autonomous Body that promotes, controls, and recommends the Government of India on protection, endurable use of biological resources, and appropriate and fair sharing of advantages from using natural resources.

• The National Biodiversity Authority advises the Central Government on matters relating to biodiversity protection, sustainable use of its components, and equitable sharing of benefits from utilizing biological resources.
• The National Biodiversity Authority recommends state governments select sites of biodiversity importance to be notified as heritage sites under Subsection (1) of Section 37 and measures for managing such sites.
• The NBA allows proposals for launching any activity directed to in Sections 3, 4, and 6 of the Act by granting permission.
• The National Biodiversity Authority, headquartered in Chennai, Tamil Nadu, India, carries out its order through a configuration with the Authority, Secretariat, SBBs, BMCs, and Expert Committees.

Composition of National Biodiversity Authority

The National Biodiversity Authority comprises a Chairperson, ex-officio members from different government ministries, and expert associates from domains like conservation, biodiversity, and traditional facts. The central government appoints the Chairperson and directs the functioning of the administration. The NBA consists of

• 1 Chairperson: A renowned person with expertise and experience in biodiversity-related issues, particularly conservation, sustainable use of natural resources, and fair benefits-sharing.
• Ex-officio Members: 10 ex-officio members from the Government of India.
• Non-Official Members: 5 non-official members of Specialists in various parts of biodiversity administration. 

The main objective and function of the National Biodiversity Authority is to preserve India's biological diversity. The NBA mainly regulates access to natural resources and provides appropriate benefits transferred from their use. The National Biodiversity Authority informs the central and state governments on biodiversity issues and advocates the construction of State Biodiversity Boards and regional Biodiversity Management Committees.

Objectives 

• Anyone pursuing intellectual property rights on analysis based on natural resources or knowledge acquired from India must first receive permission from the NBA.
• The NBA will assess benefit-sharing provisions.
• Sections 19 and 21 need previous consent of the National Biodiversity Authority (NBA) before access to natural resources and associated expertise to confirm fair sharing of benefits.
• Guarding provincial people's biodiversity knowledge through actions such as enrollment.

Functions

• NBA recommends the Central Government on biodiversity protection, sustainable usage of its components, and impartial usefulness sharing from biological resources.
• NBA suggests that state governments determine important biodiversity regions to be declared heritage sites and develop standards for handling such areas.
• NBA functions in any other positions that may be needed to fulfill the requirements of this Act.
• The National Biodiversity Authority may, on behalf of the Central Government, take any measure essential to resist the license of intellectual property rights in any nation outside India on any biological resource acquired from India or facts associated with such biological resource emanating from India.

Effectiveness of National Biodiversity Authority

The National Biodiversity Authority has increased biodiversity conservation awareness and implemented the Biological Diversity Act.
