Article 154 - Executive power of State

Part VI

The Constitution defines India as a sovereign, socialist, secular, democratic and republic country. It also outlines the structure and functioning of the government including the authority and responsibilities of important officials such as the President, Prime Minister and state Governors. Article 154 of Indian Constitution is an important provision under Part VI. Article 154 deals with the executive power of the State.

Interpretation of Article 154 of Indian Constitution

Article 154 of Indian Constitution states - “1) The executive power of the State shall be vested in the Governor and shall be exercised by him either directly or through officers subordinate to him in accordance with this Constitution. 2) Nothing in this article shall- (a) be deemed to transfer to the Governor any functions conferred by any existing law on any other authority or (b) prevent Parliament or the Legislature of the State from conferring by law functions on any authority subordinate to the Governor.”

According to Article 154 of Indian Constitution the executive power of the State is entrusted to the Governor. He may exercise these powers directly or through subordinate officers in accordance with the Constitution. 

The provision does not transfer any functions already assigned by law to other authorities to the Governor nor does it restrict the authority of Parliament or the State Legislature from delegating functions to subordinate authorities. As the executive head of the State the Governor ensures the implementation of laws and policies while the provision allows administrative flexibility through the delegation of responsibilities. 

The provision preserves the legislative authority of Parliament and the State Legislature to allocate functions to other authorities as required.

Conclusion

Article 154 of Indian Constitution vests the executive power of the State in the Governor and serves as its constitutional head and performs various functions and duties. The Governor plays an important role in ensuring a balance of power between the State and central governments.
